This Land is Your Land, This Land is My Land-Updated

Dear Readers, Some alternative news sites, such as whatreallyhappened and WingTV- report Tom Flocco and his article regarding indictments of Bush cabinet members, is said to have been "discredited". They offer no discrediting evidence themselves, except to say they did the leg work. NOTE: Site fixed

They also claim the indictment story originated from only Flocco-however, Prissy found a couple of other sources besides Flocco with very similar findings. (See previous posts) Prissy printed Flocco's article for readers to see it, for it claimed the Patrick Fitzgerald investigation would come to indict major players on team Bush.

Quite frankly, Flocco's claim, if one looks at the laws and the prima facie evidence(which means upon first examination)-is hardly inconceivable. What would be outrageous-is if team Bush continues without regard to legal precedence, upon its assault to deface the constitution and the Bill of Rights.

Citizen spook and Constant, who always cite their work -point to many potential crimes and laws potentially broken by this administration. Looking at known facts one could readily conclude a grand jury investigation would certainly be within the perimeter of law to indict- based on known evidence.

Prissy's conclusion is the following: If the United States is a country of laws, this administration is certainly not above it. Flocco may or may not be a sensationalist, but his story is certainly plausible if we are still a nation which respects the rule of law. As Prissy has said before, only time will tell....Hope for the best. If there are no grand juries looking into this copious and mounting evidence of criminal behavior by our leaders, then there is no United States of America and our legal system is a farce. Prissy believes in a nation of laws, she hopes Fitzgerald does too.

The criminal statute, 18 U.S.C., Sec. 1001, prohibits knowingly and willfully making false and fraudulent statements to Congress in documents required by law. The two uranium claims in the State of the Union Address and the report to Congress concerning Iraq were false and fraudulent, and are in documents that the White House submitted to Congress. See House Document 108-1 and House Document 108-23. The law required the president to give such reports. Article II, Section 3 of the constitution requires presidents to give State of the Union Addresses. Section 4 of Public Law 107-243, which is the Congressional resolution authorizing the war against Iraq, requires the president to give reports to Congress relevant to the war resolution and the president submitted said report on Iraq pursuant to that law. Thus 18 U.S.C., Sec. 1001 was evidently violated.

The criminal statute, 18 U.S.C., Sec. 371, prohibits conspiring to defraud the United States and is applicable since the Supreme Court in the case of Hammerschmidt v. United States, 265 U.S. 182, 188 (1924) held that to “conspire to defraud the United States means primarily to cheat the government out of property or money, but it also means to interfere with or obstruct one of its lawful governmental functions by deceit, craft or trickery, or at least by means that are dishonest.” Senior Administration officials arguably violated Section 371 because their uranium claims had the effect of obstructing or interfering with the function of Congress to reconsider its war resolution and to allow further time for U.N. weapons inspections. If the whole truth had been told, Congress may well have withdrawn the war resolution or delayed the start of the war to allow further U.N. weapons inspections, which would have shown what we now know; that Iraq had no weapons of mass destruction and had not sought the uranium. However, it should be noted that Section 371 does not require proof that the conspiracy was successful.

The "We The People Foundation" sponsored the aforementioned case which was recently dismissed by Judge Emmet G. Sullivan in the US District Court for the District of Columbia, Civil Action No. 04-1211. The attorney who represented the plainittifs today filed a response regarding the District Court's decisions. The response is as defective as the pleadings that were filed and which were properly dismissed:

"In assessing the importance of this matter we must remember that whatever legal arguments have been posed or considered, the Court ultimately relied upon the Government's statement that the right to petition the Government for a redress of grievances no longer exists.

Of course, we intend to seek a review of that decision by a higher court. In the meantime, however, it is now the law of the land that your right to petition the Government has been abolished by the executive and judicial branches of the your Government. -Mark Lane-Attorney for plantiff

Spook's take: This is a vast mistatement of Judge Sullivan's accurate opinion. I am directing the following exhaustive analysis to the We The People Foundation and their attorney, Mark Lane, in the hope that they will reconsider their post dismissal statement and react accordingly.

Citizen Spook has thoroughly reviewed the pleadings and the District Court's opinion.

This case was properly dismissed according to controlling legal precedent. However, the "We The People Foundation" must be congratulated for scoring an important victory which is discerned by a thorough review of Judge Sullivan's historic and remarkable opinion which acts as map for a new and improved first amendment petition for a redress of grievances as to the federal income tax problem.

I hope that the plaintiffs and their attorney, Mark Lane, will review this report and withdraw their appeal in favor a new and improved version of this lawsuit.

The report, which comes after a request by Rep. John Conyers (D-MI) to review the law and legal accountability relating to Federal action in response to Hurricane Katrina, unequivocally concludes that she did.
