Mac WorldFrance bans citizen journalists from reporting violence

The French Constitutional Council has approved a law that criminalizes the filming or broadcasting of acts of violence by people other than professional journalists. The law could lead to the imprisonment of eyewitnesses who film acts of police violence, or operators of Web sites publishing the images, one French civil liberties group warned on Tuesday.

The council chose an unfortunate anniversary to publish its decision approving the law, which came exactly 16 years after Los Angeles police officers beating Rodney King were filmed by amateur videographer George Holliday on the night of March 3, 1991. The officers’ acquittal at the end on April 29, 1992 sparked riots in Los Angeles.

If Holliday were to film a similar scene of violence in France today, he could end up in prison as a result of the new law, said Pascal Cohet, a spokesman for French online civil liberties group Odebi. And anyone publishing such images could face up to five years in prison and a fine of €75,000 (US$98,537), potentially a harsher sentence than that for committing the violent act.

VLADIMIR PUTIN: One can hardly use the same terminology in international relations, in relations between countries, that would apply to relationships between people — especially during their honeymoon or as they prepare to go to the Civil Registry Office.

Throughout history, interests have always been the main organising principle for relations between states and on the international arena. And the more civilised these relations become, the clearer it is that one’s own interests must be balanced against the interests of other countries. And one must be able to find compromises to resolve the most difficult problems and issues.

One of the major difficulties today is that certain members of the international community are absolutely convinced that their opinion is the correct one. And of course this is hardly conducive to creating the trusting atmosphere that I believe is crucial for finding more than simply mutually acceptable solutions, for finding optimal solutions. However, we also think that we should not dramatise anything unduly. If we express our opinions openly, honestly and forthrightly, then this does not imply that we are looking for confrontation. Moreover, I am deeply convinced that if we were able to reinstate honest discussion and the capacity to find compromises in the international arena then everyone would benefit. And I am convinced that certain crises that face the international community today would not exist and would not have had such a dire impact on the internal political situation in certain countries. For example, events in Iraq would not be such a headache for the United States. This is the most vivid, sharpest example but, nevertheless, I want you to understand me. And as you recall, we were opposed to military action in Iraq. We now consider that had we confronted the problems that faced us at the time with other means then the result would have been — in my opinion — still better than what we have today.

It is for that reason that we do not want confrontation; we want to engage in dialogue. However, we want a dialogue that acknowledges the equality of both parties’ interests.

Say what you want about Putin, but he is much smarter than Dubya...

Mercury News AP: Government drafts pandemic flu plan

The Bush administration forecasts massive disruptions if bird flu or some other super-strain of influenza arises in the United States. A response plan scheduled to be released at the White House on Wednesday warns employers that as much as 40 percent of the work force could be off the job and says every segment of society must prepare.

"The collective response of 300 million Americans will significantly influence the shape of the pandemic and its medical, social and economic outcomes," says an undated 228-page draft version of the report that had not been finalized. "Institutions in danger of becoming overwhelmed will rely on the voluntarism and sense of civic and humanitarian duty of ordinary Americans."

An outbreak could lead to a variety of restrictions on movement in and around the country, including limiting the number of international flights and quarantining exposed travelers. But the government does not foresee closing U.S. borders to fight the spread of flu, in part because it would only slow the pandemic's spread by a few weeks and because it would have such significant consequences for the economy and foreign affairs.

FBI Secretly Sought Data on 3,501 People in '05

Washington - The FBI secretly sought information last year on 3,501 U.S. citizens and legal residents from their banks and credit card, telephone and Internet companies without a court's approval, the Justice Department said Friday.

It was the first time the Bush administration has publicly disclosed how often it uses the administrative subpoena known as a national security letter, which allows the executive branch of government to obtain records about people in terrorism and espionage investigations without court approval.

Friday's disclosure was mandated as part of the renewal of the Patriot Act, the administration's sweeping anti-terror law.

Ellen Mariani, who lost her husband Neil on United Air Lines (UAL) Flight 175, filed the first 9-11 wrongful death lawsuit against UAL on Dec. 20, 2001. Mariani was interviewed on national television in May 2002 by Bill OÂ’Reilly of Fox News, who repeatedly questioned her about why she had chosen to pursue litigation instead of accepting the government fund.

"I want justice," Mariani said. “I want accountability. Who is responsible? I want the truth."”

Today, Mariani, like the other 9-11 plaintiffs, is under a gag order which prevents her from speaking about her ongoing lawsuit. Likewise, thousands of employees of federal agencies like the Federal Aviation Administration have received gag orders in the mail keeping them from telling what they know about the events of 9-11.

Washington Post US could seek Iran sanctions outside UN: Bolton

Under questioning by Democrats, Bolton said he had not read an article in the New Yorker magazine that the United States had covert military operations in Iran "because I don't have time to read much fiction."

He also rebuffed persistent questions from Democrats on whether in his previous post as the State Department's top arms control diplomat, he had a role in writing administration documents making now discredited assertions about Iraq's pursuit of nuclear weapons.

"I'm sorry to disappoint you, Congressman. I had no role in this issue," Bolton told Rep. Henry Waxman of California, top Democrat on the Government Reform committee.

Rep. Stephen Lynch, a Massachusetts Democrat, remarked that it was "stunning that you were not in the loop."

Feds Go All Out to Kill Spy Suit

National security could be protected, while still allowing cases to move forward, if judges allowed notes and evidence to be seen only in a special room by lawyers with security clearances -- as has happened in Guantanamo Bay criminal cases -- or if judges shut down courtrooms during sensitive sessions, according to Shayana Kadidal, a staff attorney at the Center for Constitutional Rights, which is separately suing the NSA in an effort to stop what it calls unconstitutional wiretaps.

"The government is asserting that none of that is good enough," Kadidal said. "They are saying, 'This is so sensitive we can't rely on the judge.'" Weaver calls that decision political.

"The privilege is being used to hide criminal activity -- embarrassing activity -- and protect the president from adverse publicity and close off the investigation," Weaver said.

Charles Miller, a Justice Department spokesman, denies that the government is trying to hide any wrongdoing.

My war was Vietnam. I did four rotations, starting in 1967 and ending with the treaty-required withdrawal of all American troops on March 23, 1973. From there, I went to Thailand to support the continuing USAF missions over Vietnam. I learned a lot, and I thought my country and my military did, too. I became a Congressional candidate because of something that happened during my third tour. One morning a young Seabee came to me, his company commander, and told me he had just gotten a letter from his wife telling him he had a new son. He asked if I could put him in a less-exposed place because he wanted to get home to see his son. I did, but he was killed the next day. I was a supporter of the war, in those days because I believed what I was being told. But after the war, when I read what others had to say, and compared it to my experiences, I came to believe that the whole premise of the war was mistaken. I went back to Vietnam in 2003, and confirmed for myself that we were in the middle of a civil war. Vietnam today is no different from all the other countries in Southeast Asia; this is after the other side outlasted us and after more than 50,000 of my fellow troops were killed. I made a promise that if ever our troops were being sent on another fool's mission, I would do whatever I could to change that. We are on a fool's mission, and I am running for Congress.

That Seabee was killed by an IED. It was made from halite melted out of an unexploded U.S. aerial bomb, and detonated using a discarded PRC-25 radio battery. He was driving a 5-ton Tactical Truck whose "armor"” consisted of sandbags on the floorboards. If you look on my website, you'll see a picture of me driving my M-151 Jeep, gunner at the ready. He was my company clerk, an E-6 Yeoman. What you don't see is the 'hillbilly armor' in the form of half inch steel plates welded underneath the gas tank I am sitting on and the sandbags on the floor.

ABC Exclusive: Top CIA Official Under Investigation

As executive director of the CIA, Foggo oversees the administration of the giant spy agency. He was appointed to the post by CIA Director Porter Goss after working as a midlevel procurement supervisor, according to former CIA officials.

While based in Frankfurt, Germany, he oversaw and approved contracts for CIA operations in Iraq.

Foggo is a longtime friend of Brent Wilkes, referred to as co-conspirator No. 1 in government documents filed in the Cunningham investigation. The two played high school football and were in each other's weddings.

According to government documents, Wilkes gave Cunningham $630,000 in cash and gifts in exchange for help in getting government contracts.

As of this time, no other mainstream media have reported on the effect of Stephen Colbert's brilliant performance that followed Bush's buffoonery at the White House Correspondents dinner. It seems there is a concerted, deliberate media blackout. The scathing satire that set the president fuming (and the audience stunned to silence) hit too close to home.

AND ... once again, the internet has scooped the media. The internet is buzzing about Colbert; the videos have gone 'viral'. The scene of the press jumping to their feet to applaud Bush is being juxtaposed with scenes from years ago when these same sycophants roared with laughter at Bush's insulting skit ("Where are the WMDs?") The transcript of Colbert's presentation is being shared all over the net.

Colbert was not funny; we who watched at home were not laughing. It is hard to laugh at satirical truths about a man who is responsible for so much death and destruction and who so blatantly lies to us. It is hard to watch news correspondents honor and rush to be photographed with this man. Colbert made us look at this as it was happening. He made us drink the "backwash" of this incestuous corporate-government-media poison.

Colbert did not make us laugh. Colbert screams for us.

AP News Reno Files Challenge to Terror Law

Some of the eight attorneys named in the document are now in private practice and represent detainees at the military base in Guantanamo Bay, Cuba. Most served under President Clinton, though the list includes former U.S. Attorneys W. Thomas Dillard and Anton R. Valukas, who served under President Reagan.

"The existing criminal justice system is more than up to the task of prosecuting and bringing to justice those who plan or attempt terrorist acts within the United States - without sacrificing any of the rights and protections that have been the hallmarks of the American legal system for more than 200 years," the attorneys wrote.

And..."These are complex and difficult legal issues, and while we respect the right of other legal minds to be heard on these issues, we believe we are on firm legal footing in this case as both the magistrate judge and district court concluded," Blomquist said.

Last weekend, Attorney General Alberto Gonzales defended the nation's handling of the detainees. He said they are afforded more rights than required.

The Central Intelligence Agency has acknowledged for the first time the existence of two classified documents, including one signed by President George W. Bush, that have guided the agency's interrogation and detention of terror suspects.

The CIA disclosed the existence of the documents in a letter Friday sent from the agency's associate general counsel, John McPherson, to lawyers for the American Civil Liberties Union.

The contents of the documents were not revealed, but one document, as described by the ACLU, is "a directive signed by President Bush granting the CIA the authority to set up detention facilities outside the United States and outlining interrogation methods that may be used against detainees."

The second document, according to the group is a Justice Department legal analysis "specifying interrogation methods that the CIA may use against top Al Qaeda members.

CBC Canadian army needs reservists to fill gaps in Afghan mission: commander

Canada's mission in Afghanistan has put the Canadian army under so much strain that it is relying increasingly on reservists to sign on as full-time soldiers, the head of the army told a parliamentary committee on Monday.

Reuters Rwanda's Kagame should face court: French judge

A top French judge has called for Rwandan President Paul Kagame to be brought before a U.N. court over a 1994 plane crash that killed the country's president and sparked a genocide, a judicial source said on Tuesday.

Anti-terrorism magistrate Jean-Louis Bruguiere is also seeking international arrest warrants against nine Kagame associates, including the military's chief of staff, according to an official document seen by Reuters.

Rwanda's foreign minister dismissed the arrest warrants as an attempt to cover up what Rwanda says was France's role in training soldiers who carried out the genocide.

Baghdad - Iraq and Syria have announced the restoration of diplomatic ties severed 25 years ago and said they had agreed to co-operate on security matters.

"We have signed a little while ago an agreement to restore complete diplomatic relations with Syria," Iraq's foreign minister Hoshyar Zebari told reporters at a joint news conference with his visiting Syrian counterpart Walid Muallem.

The trouble is that at least some of the secrets the government is trying to protect are the very techniques used against people such as Mr. Khan -- and its means of protecting them is to muzzle him about what the CIA did to him. CIA official Marilyn A. Dorn said in an affidavit that Mr. Khan might reveal "the conditions of detention and specific alternative interrogation procedures." In other words, grossly mistreating a detainee now justifies keeping him quiet.

The problem with this argument is not just its Kafkaesque sheen. If the courts accept it, it would have vast practical implications. The integrity of any military trials of the high-value detainees will depend on their excluding evidence obtained by unduly coercive means. By the logic of the government's argument, however, all of that litigation will have to take place in secret. Detainees are also supposed to be able to appeal their status as enemy combatants to the federal appeals court here in Washington. The government's logic would all but assure that the bulk of any such appeal would be secret as well. So accepting this theory would mean that no claim of torture could be resolved in a transparent and accountable fashion. Given the importance of open trials for the high-value detainees, it's hard to imagine a principle that would more thwart the effort to bring them credibly to justice.

A British Muslim falsely confessed to planning to bomb several high-profile English landmarks after being tortured and subjected to degrading conditions in Pakistan, his defense lawyer said on Tuesday.

Salahuddin Amin, 31, was subjected to "inhumane" treatment by the Pakistani Intelligence Service (ISI) during 10 months of incarceration, Patrick O'Connor told a London court.

The torture took place with the knowledge of British intelligence agencies although no British agents were actually involved or witnessed it, he said.

The ruling supports federal law that clears individuals of liability if they transmit, but are not the source of, defamatory information. It expands protections the law gives to Internet service providers to include bloggers and activist Web sites.

'We acknowledge that recognizing broad immunity for defamatory republication on the Internet has some troubling consequences,' California's high court justices said in their opinion.

Several other House races nationwide remain unresolved: In Ohio's 2nd District, a few counties began counting provisional and absentee ballots in the disputed race between GOP Rep. Jean Schmidt, a Republican who called decorated Vietnam veteran Rep. John Murtha a coward, and Democrat Victoria Wulsin. Schmidt led by about 2,800 votes, though nearly 9,000 votes could remain to be counted in the district.

In Ohio's 15th District, Republican incumbent Deborah Pryce was ahead of Democrat Mary Jo Kilroy by more than 3,500 votes. Some 19,000 ballots remain to be counted, with results expected next week.

Maoist fighters in Nepal have signed a peace agreement with the country's government.

The agreement signed by Girija Prasad Koirala, Nepal's prime minister and Prachanda, the Maoist leader, is the formal end to a civil conflict which has killed more than 13,000 people.

The deal has been reached seven months after King Gyanendra surrendered power to political parties following weeks of street protests.

Zaman Turkey Kurdish Side Claims to Fight against PKK

Iraq’s Foreign Minister Hosyar Zebari has announced that an official from the Kurdish Local Administration is participating in the joint Turkey-USA-Iraq bid to curb Kurdistan Workers Party (PKK) terrorism.

In a statement in the Kurdish Nwe newspaper, Zebari said: “Of course the representative of the Kurdish administration is also attending the meetings. And that is Interior Minister Kerim Senkali.”

While the Turkish foreign ministry has denied such claims, the Iraqi embassy in Ankara said it had assigned Senkali and Shirvan al-Vaili as Iraqi delegates to fight terrorism.

LAHTI, Finland (Reuters) - Britain and Germany warned President Vladimir Putin before talks on Friday he must give European firms a fair chance to exploit Russia's huge energy resources or risk seeing foreign investors take flight.

Putin is the guest at a European Union dinner where the bloc's 25 leaders will push him for better energy ties but also raise the killing of journalist Anna Politkovskaya and the Kremlin's heavy-handed treatment of former Soviet Georgia.

The Europeans are dismayed by Kremlin moves questioning contracts signed in the 1990s by firms including Royal Dutch Shell and Total, and by a decision to shut foreign capital out of development of the Shtokman gas field.

Mr. Putin, considered nearly a progressive, considering his former KGB background, seems to be withdrawing a bit with "problems at home." Federal prosecutors charge that Rezko leveraged his influence with state leaders to extort illegal payments and a campaign contribution from investment firms seeking to do business with Illinois. Despite the official escort--agents met Rezko's plane as it landed Thursday at O'Hare International Airport--Rezko walked into court seemingly unconcerned, waving to family members and shaking his lawyer's hand.

Five years after 2,749 people died in the World Trade Center attack, families of about 1,150 victims still have not received word that their loved ones' remains were found amid the rubble.

The remains of Charles Wolf's wife, Katherine, 40, were never recovered. He said his wife, an employee of insurer Marsh & McLennan, was on the 97th floor of the north tower when the building collapsed.

"I am totally shocked that this was found in the pit," said Wolf, 52, who was notified of the discovery by television stations.

"The fact that they were found in ground zero says there was some major, major shortfall in the recovery effort," Wolf said. "Where else are we going to find them next?"

Not just, as Morse had suggested, the contents of a few files on the events surrounding the Tonkin Gulf incident—all that I had in early August—but the drawerfuls of critical working papers, memos, estimates, and detailed escalation options revealing the evolving plans of the Johnson Administration for a wider war, expected to commence soon after the election. In short, what if I had put out before the end of the year, whether before or after the November election, all of the classified papers from that period that I did eventually disclose in 1971?

Had I done so, the public and Congress would have learned that Johnson’s campaign theme, “we seek no wider war,” was a hoax. They would have learned, in fact, that the Johnson Administration had been heading in secret toward essentially the same policy of expanded war that his presidential rival, Senator Barry Goldwater, openly advocated—a policy that the voters overwhelmingly repudiated at the polls.

I would have been indicted then, as I was seven years later, and probably imprisoned. But America would have been at peace during those years. It was only with that reflection, perhaps a decade after the carnage finally ended, that I recognized Morse had been right about my personal share of responsibility for the whole war.

Not just mine alone. Any one of a hundred officials—some of whom foresaw the whole catastrophe—could have told the hidden truth to Congress, with documents. Instead, our silence made us all accomplices in the ensuing slaughter.

For his part, Boehner hosted weekly meetings with top Washington business lobbyists and conservatives for a few years right after the GOP won control of Congress in 1994. Boehner, who like DeLay boasted very strong ties to the tobacco lobby in Washington, once earned notoriety by handing out checks from the industry on the House floor.

Ultimately, in the struggle to succeed DeLay in early 2006, Boehner won out largely because the ties between Blunt's world and DeLay's seemed more obvious. But Boehner, who briefly talked tough about lobbying reforms in early 2006, soon backed away from almost all stringent measures to reform the pay-to-play system, as did many of his colleagues in the House. One perk that Boehner was particularly concerned to preserve was the ability of members to take privately funded junkets, not unlike the kind that Abramoff was so good at organizing. According to an independent survey done by the Campaign for a Cleaner Congress, Boehner had taken 180 trips since 1999 outside his district -- including quite a few to such golfing destinations as St. Andrews in Scotland and Pebble Beach in California -- ranking him among the ten most prolific travelers in the House.

Boehner's views about the importance of preserving private travel ultimately prevailed. At the start of 2006, House Speaker J. Dennis Hastert publicly proclaimed that he favored putting "an end" to private travel because of abuses. But the very weak lobbying reform bill that passed the House -- but never was enacted -- included a much-watered-down provision that only suspended such trips and only until June 15, 2006, a token gesture at best.

Ironically, just as they were caving on the idea of banning private travel, studies showed such trips proliferating. PoliticalMoneyLine in early 2005 revealed that some 600 members of Congress since the year 2000 have gone on 5,410 trips that were privately funded at a cost of $16 million.

Reuters Pentagon to resume forced anthrax vaccine program

But William Winkenwerder, assistant secretary of defense for health affairs, said the Pentagon has no plans to vaccinate troops serving elsewhere, including those in the United States -- site of the only major anthrax attack against Americans, which killed five people in 2001.

"There are terrorists operating in and around Iraq and in that part of the world," Winkenwerder said. "That's a higher threat area."

And..."The forthcoming mandatory program is just as senseless as before and the FDA's new determination remains legally and scientifically flawed," said Mark Zaid, one of the attorneys.

Winkenwerder, who has not taken the anthrax vaccine, said the FDA's final order settles legal questions and the Pentagon is prepared for a court challenge.

Not many know of Connecticut's witch trials because they were eclipsed, both at the time and today, by Salem's sensational trials in 1692, said Walter Woodward, Connecticut's official state historian.

The Massachusetts Colony hanged 19 accused witches before the hysteria was spent, though five others accused of witchcraft died as well, either during interrogations or in prison.

Many of the accused witches here and in Massachusetts were women, in part because they dealt in the healing arts or as midwives.

Avery's ancestor was Mary Sanford, a 39-year-old mother of five who was accused of witchcraft by neighbors because she drank sherry at night in the woods behind her home. She was tried in Hartford, found guilty and hanged.

South Korea's Yonhap news agency reports North Korean leader Kim Jong Il told a visiting Chinese envoy that Pyongyang plans to conduct no further nuclear tests. Kim made the statement in Pyongyang on Thursday during talks with Chinese State Councillor Tang Jiaxuan, the agency quoted an unidentified 'informed diplomatic source' as saying in Beijing. Japan's Foreign Ministry said it could not confirm or deny the report, which came as US Secretary of State Condoleezza Rice was in Beijing to rally support for UN sanctions against North Korea in response to its nuclear test on October 9.

The Australian News Baghdad operation backfires on US

The operation "has not met our overall expectations of sustaining a reduction in the levels of violence", Major General Caldwell said.

"We are working very closely with the Government of Iraq to determine how best to refocus our efforts."

In Washington, Pentagon spokesman Lieutenant Colonel Mark Ballesteros called Major General Caldwell's assessment "accurate and candid".

His comments are a rare public admission that an American strategy in Iraq hasn't worked, and it came as Republicans and Democrats in Washington press the Bush administration to devise a new approach.

USAToday Maltese diocese to investigate case of priest who said he was naked with Foley

On Wednesday, he told the Sarasota (Fla.) Herald-Tribune by telephone that he massaged the boy in the nude and was naked in the same room on overnight trips with him. On Thursday, he told The Associated Press that he was naked in a sauna with Foley and had gone skinny-dipping with him.

Also Thursday, he told WPTV of West Palm Beach, Fla., that he touched Foley "once, maybe."

In all of the interviews, he denied having sexual intercourse with Foley.

"It's not something you call, I mean, rape or penetration or anything like that, you know," he told the TV station in a telephone interview. "It was just fondling."

Only? People need to know most pedophiles are not aggressive about it, they don't have to be to coerce children. Back in the days of old, the adult- congressman or priest- would have been given credible standing over a youth.

Isn't that right, Mr. Foley? Why, he had counted on it for years...
